Jack Smith presented his final report to the Justice Department. This last action against Donald Trump by this prosecutor stated that there was enough evidence to convict Donald Trump of trying to overturn the results of the 2016 election.
Were Trump not elected President of the U.S. in the 2024 election Jack Smith stated he would have prosecuted Donald Trump. But the Department of Justice has a long-standing rule of not prosecuting a sitting President of the U.S and this standard applies to an elected President as well.
Jack Smith also stated that the Supreme Court of the United States stalled on ruling the case on immunity which also prevented the Insurrection case from going to trial.
